The Administrative Court, Supreme Tribunal of Justice (TSJ),
refused to authorize private television network RCTV -Venezuela's
oldest television channel- to go back in the air on open signal,
for the second time since May 27, 2007, when it was compelled
to stop broadcasts on open signal.
The high court dismissed an action filed last November by
RCTV's lawyers, who requested the court to authorize resumption
of RCTV operations pending a decision on whether the government's
move not to renew the broadcast license to the network was
lawful or not.
Chair of the Administrative Court, judge Evelyn Marrero in
her ruling overruled the petition, claiming that if she upheld
the request she would be incurring in prejudgment. This is
the same allegation she argued to dismiss a similar action
in August 2007.
