Reporter Leocenis García rejected the fact that some
sectors in Venezuela are "celebrating" the occurrences in
connection with ExxonMobil-Pdvsa dispute, but pointed to an
advisor of the Solicitor General's Office as one of the major
culprits for the legal dispute.
"I am deeply concerned that an irresponsible sector in this
country is celebrating the incidents related to Exxon Mobil's
lawsuit against the Bolivarian Republic of Venezuela," he
said.
In his view, this case began when the International Center
for Settlement of Investment Disputes (ICSID) upheld a complaint
against Venezuelan state-run Agriculture Development Bank
(Bandagro) in connection with some promissory notes issued
by the financial institution. According to García, the
fact that the ICSID agreed to become an arbiter in this case
runs counter the Venezuelan Constitution and the Vienna Convention.
"Responsibility partly lies with the sector in the country
that initialed the operational agreements. However, it is
also true that it was the Solicitor General's Office the body
that agreed to the arbitration of the ICSID, with advisory
provided by Hidelgar Rondón de Sanzón, who is the
mother-in-law of (Venezuelan Minister of Energy and Petroleum
and CEO of Pdvsa) Rafael Ramírez. According to notarized
documents, she (Hildegar Rondón de Sanzón) is Pdvsa's
legal representative in international cases."
